End User License Agreement

Effective Date: 16/06/2025 (Updated July 2026)

This End User License Agreement (“Agreement”) is a legal agreement between you and Gooday Corporation Pty Ltd (“Goodtimes”, “we”, “us”, or “our”) governing your use of the Goodtimes mobile application, website, and associated services (“App”). By downloading, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use the App or any Goodtimes Services.

1. License

Goodtimes grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App on any device you own or control, solely for your personal, community, or business use, subject to the terms of this Agreement.

2. Restrictions

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
  • Modify, adapt, translate, or create derivative works of the App;
  • Rent, lease, lend, sell, sublicense, or redistribute the App;
  • Use the App for any unlawful, fraudulent, harmful, or malicious activity;
  • Use the App in a way that interferes with Goodtimes’ services, users, or partners;
  • Circumvent or attempt to bypass any security, authentication, or fee structure;
  • Engage in Trojan Horsing, including harvesting user data or redirecting users to external platforms.

3. Account and Subscriptions

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate and complete information;
  • Maintain the confidentiality of your login credentials;
  • Notify us immediately of any unauthorized access or security breach.

If you purchase a subscription or paid feature, payments are processed securely through our designated payment provider. Subscription terms, billing frequency, cancellation, and refund policies are detailed within the App and on our Terms & Conditions page at: https://www.goodtimesapp.co

4. Bookings and Business Interactions

Goodtimes enables users to discover, schedule, RSVP, and pre-pay for events and services offered by third-party Businesses and Social Clubs.

Goodtimes does not provide these services and is not liable for:

  • The performance, quality, safety, or legality of any third-party event or service;
  • Business or Social Club availability, cancellations, or policies;
  • Any disputes between Consumers and Businesses.

Businesses and Social Clubs are solely responsible for their own services, pricing, policies, and compliance with applicable laws.

5. Intellectual Property

All content, trademarks, branding, software, and intellectual property within the App are owned or licensed by Goodtimes and protected under applicable laws. This Agreement does not grant you any rights to use Goodtimes’ intellectual property except as explicitly stated.

6. Data & Privacy

Your use of the App is subject to the Goodtimes Privacy Policy, available at: https://www.goodtimesapp.co

By using the App, you consent to the collection, use, and processing of your data in accordance with that policy, including:

  • Calendar syncing (optional);
  • Event recommendations;
  • Booking facilitation;
  • Community coordination;
  • Research, analytics, and product improvement.

7. Termination

This Agreement remains effective until terminated by you or Goodtimes. Your rights under this Agreement will automatically terminate if you fail to comply with any terms.

Upon termination, you must:

  • Cease all use of the App;
  • Delete all copies of the App from your devices.

Goodtimes may suspend or terminate your account for:

  • Fraudulent activity;
  • Security risks;
  • Trojan Horsing;
  • Misuse of the platform;
  • Violations of this Agreement.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind. Goodtimes disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the extent permitted by law, Goodtimes is not liable for:

  • Indirect, incidental, special, or consequential damages;
  • Loss of data, profits, or business opportunities;
  • Damages arising from your use or inability to use the App.

Where limitations are not permitted, liability is limited to the maximum extent allowed by law.

10. Governing Law

This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to This Agreement

Goodtimes may update this Agreement from time to time. We will notify you of material changes through the App or via email. Continued use of the App after such notice constitutes acceptance of the updated terms.
